The Crimean "Trophy Economy": The Sale of Ukrainian Property. An Updated Review for 2014 – 2021

Since the first months of the annexation of Crimea, the attitude towards property rights on the occupied peninsula has been defined by the general logic of the territory seized to be used as a military base, or what we refer to as the "trophy economy". It is characterized not only by gross violations of the legal norms established in the civilized world but by the complete neglect thereof.

This applies not only to enterprises of the military-industrial complex, resources of the Ukrainian shelf, and marine biological resources. Large-scale expropriation of all state-owned property of Ukraine on the territory of Crimea, which has been cynically called "nationalization," has been carried out. The famous Nikitskyi Botanical Garden, Artek International Children's Centre, and unique nature reserves have also been expropriated.

The expropriation, however, has not been limited to state-owned Ukrainian property. The facilities belonging to trade unions, community organizations, universities, and the Academy of Sciences have also been "nationalized." Moreover, illegal takeovers of private companies are taking place.

Decisions on the property were among the first ones taken by the occupying power. The main ones were the following:

1. The Resolution of the "State Council of the Republic of Crimea "On property nationalization of agricultural companies, institutions and organizations in the Republic of Crimea" (26 March 2014, No. 1836–6/14).
2. The Resolution of the "State Council of the Republic of Crimea "On aspects of administration of the property of the Republic of Crimea" (30 April 2014, No. 2085-6/14) with subsequent amendments.
3. The law "On special aspects of regulation of property and land matters in the Republic of Crimea" (31 July 2014, No. 38-ZRC).
4. The law "On the administration and disposition of state-owned property in the Republic of Crimea" (8 August 2014, No. 46-ZRC).

Resolution No. 2085-6/14 initially concerned only property without an owner and the property of the state of Ukraine. But during 2014-2021, 90 resolutions on amendments have been adopted (the last one is dated 28 June 2021), entitled The List of Property Registered as the Property of the Republic of Crimea.

These new resolutions added hotels, health retreats, holiday facilities, markets, gas stations, industrial, transport and agricultural enterprises, elevators, banks, ships, private flats, non-residential buildings, and land plots to the list of property. The list now includes not only state-owned but also privately owned properties and those belonging to Ukrainian civil organizations.

The adopted resolutions did not contain any criteria for nationalization or, in most cases, information on the owners of the nationalized property.

According to the Office of the United Nations High Commissioner for Human Rights (OHCHR), as of 28 August 2017, the above-mentioned annexe listing the nationalized property had changed 56 times and contained 4,618 "nationalized" public and private pieces of real estate. That is, over the following 3 years, another 34 pieces were added to the list.

The authors believe that counting "nationalized" properties mechanically becomes pointless when numbers reach such proportions because an item on such lists can be anything from a small building or even a flat to a huge health retreat, factory, or seaport.

The expropriation, however, has not been limited to state-owned Ukrainian property. The facilities belonging to trade unions, community organizations, universities, the Academy of Sciences have also been "nationalized. Moreover, illegal takeovers of private companies are taking place.

The OHCHR has reminded that,

according to international humanitarian law, private property, as well as the property of municipalities and institutions dedicated to religion, charity and education, the arts and science may not be confiscated, and that immovable public property must be administered according to the rule of usufruct (the right to use someone else's property and receive income from it provided its substance is neither impaired nor altered.)

According to the laws of the Russian Federation (RF), nationalization stipulates the payment of compensation. However, in 2014, the "strategic importance of an enterprise" or claims that "an enterprise did not conduct business" were used in occupied Crimea as a reason for nationalization without compensation. In 2015, another excuse for the nationalization became common, namely that the deadline set by the occupation authorities for re-registering the enterprises under the Russian legislation expired on 1 March 2015.

Thus, as a result of the "trophy excitement," Crimean collaborators and their Moscow supervisors, who quickly arrived in the peninsula, found themselves needing to administer a vast amount of various property of the state of Ukraine, trade unions, research organizations, private enterprises, banks, etc.

This created huge challenges related to administering these facilities, whose functioning or at least maintenance had to be ensured.

As expected, the Crimean occupation authorities lacked the required skills to manage such an amount of complex and diverse "trophy property." This became apparent in the first year of the occupation. Therefore, several techniques for dealing with trophy property in occupied Crimea have been adopted.

1) sale;
2) transfer to the central authorities of the Russian Federation;
3) transfer to the authorities of constituent entities of the Russian Federation;
4) attempts to establish profitable operation of trophy facilities independently, at the Crimean level;
5) transfer to municipal ownership.

We will provide just the most striking and telling examples in the fields of tourism and winemaking, which are rightly considered the areas of specialization of the Crimean peninsula (for the facilities of the military-industrial complex, oil and gas production, and marine bioresources, see the respective sections of this publication, entitled The Trophy Economy).

The Sale of the Crimean Resort*

There are over 620 large resort facilities belonging to the state of Ukraine, Ukrainian enterprises and organizations on the territory of the Autonomous Republic of Crimea. All of them were expropriated in 2014.

About 40% of these facilities work all year round (health retreats, holiday facilities, and hotels), another 60% are seasonal (these are mostly children's camps and recreation facilities of Ukrainian enterprises and higher education institutions).

Most of them belong to the state of Ukraine (administered by ministries and departments, state-owned enterprises and educational institutions, the National Academy of Sciences of Ukraine, academies specializing in various scientific disciplines, research institutes, and higher education institutions) or trade unions and other civil organizations.

The Monitoring Group of the Black Sea Institute of Strategic Studies and BlackSeaNews has confirmed, based on documentary sources, the facts of expropriation of 199 Crimean resort and recreation facilities*, including:

the city of Simferopol and the Simferopol district – 11,
the city of Saki and the Saki district – 10,
the city of Bakhchysarai and the Bakhchysarai district – 8,

the Chornomorskyi district – 10,
the Kirovskyi district – 1.

In 2016, the Foros health retreat was acquired by the Federation of Trade Unions of the Republic of Tatarstan, which, according to Russian sources, could not have possibly had the 1.4 billion roubles needed to buy the facility.

Later, the Chairman of the Federation of Independent Trade Unions of Russia, Mikhail Shmakov, admitted that the trade unions had acted as an intermediary in the deal, having received funds from large regional companies, most likely, KAMAZ, Tatneft, and petrochemical enterprises that didn't want to be put on sanctions lists.

In 2017, among the stolen property, three well-known health retreats on the South coast of Crimea, Diulber owned by the Administrative Directorate of the Verkhovna Rada of Ukraine and two health retreats belonging to the Ukrainian trade unions, Miskhor and Ai-Petri, were put up for sale, as well as five other health retreats and children’s camps.

At first, only two holiday facilities found their buyers – Enerhetyk in the urban-type settlement of Mykolaivka and Gornyi in Yalta – both owned by Ukrainian state enterprises.

The Miskhor, Ai-Petri, and Diulber health retreats were bought at the second attempt by the firm of Colonel-General Vladimir Zaritsky, a former Commander of the Missile Troops and Artillery of the RF.

The Miskhor health retreat with a park area of 3 hectares cost the company 380 million roubles, Ai-Petri (5.7 hectares and 1 hectare of beach) – 416.4 million roubles, and Diulber (the area is 22.34 hectares, a former palace of a Grand Duke and a member of the imperial family) – 702.7 million roubles.

At the same time, the failure to sell many of the expropriated Ukrainian health retreats has resulted in the practice of transferring the ownership or administration of these facilities to the republics of the RF, such as Tatarstan, Chechnya, Ingushetia, Bashkortostan, free of charge.

In 2017, the children's camp Krymkoopspilka in Alushta was transferred to the government of Chechnya and the children's cardiologic health retreat Yuvileinyi in Yevpatoriia – to Bashkortostan.

In 2018, the children's health retreat Pioner near Yevpatoriia with a park of 12 hectares and a beach of 1.4 hectares was transferred to Ingushetia.

In September 2021, the children's clinical cardiorheumatological health retreat Bryhantyna in Yevpatoriia was transferred to Belgorod oblast, a constituent entity of the Russian Federation.

The health retreat Ukraina, which was renamed Rodina after the expropriation, is now called the Federal State Treasury Institution Health Retreat of the Investigative Committee of the Russian Federation Rodina

In December 2020, the Russian government issued an order according to which the renamed health retreat Ukraina, owned by the Trade Unions of Ukraine, was transferred to the federal property of the Russian Federation. At the beginning of 2021, this health retreat was transferred by the Russian government to the Investigative Committee of the Russian Federation.

The health retreat Ukraina, which was renamed Rodina ("Родина") after the expropriation, is now called the Federal State Treasury Institution Health Retreat of the Investigative Committee of the Russian Federation Rodina (Федеральное государственное казенное учреждение "Санаторий Следственного комитета Российской Федерации "Родина").

The occupation authorities of Crimea certainly understand the toxicity of the re-sold stolen property to the new buyers. Therefore, to cover the tracks of the re-sold booty, in addition to the "privatization" organized by the occupation "Ministry of Property and Land Matters," Russia frequently uses the scheme of property "alienation."

For this purpose, the "Property Disposal Directorate of the Republic of Crimea" was established, which is in charge of 47 facilities offered for sale. The "know-how" of the directorate is combining separate property parts belonging to different Ukrainian owners into one object for sale.

In November 2018, it was that directorate that sold the buildings of the Livadia health retreat in Yalta, belonging to the Trade Unions of Ukraine, including several buildings of the Livadia Palace, where the famous Yalta Conference, a meeting of the Big Three, was held in 1945. The buildings were sold to the Russian businessman Konstantin Malofeyev for 509.6 million roubles.

In 2019, the same directorate sold the presidential state residence No. 1 Hlitsyniia, famous as the favourite vacation spot of the USSR leaders. The property is owned by Ukraine and was administered by the State Management of Affairs of the President of Ukraine. The cost was 1.2 billion roubles.

The buyer has not been disclosed. After the occupation of Crimea, it was handed over to the Federal Security Service of the Russian Federation.

Besides, as mentioned above, intermediary buyers are used.

The government of the Russian Federation will increasingly put pressure on the Crimean occupation authorities to sell off the Ukrainian property as soon as possible to at least somewhat reduce the Russian burden of maintaining the peninsula.

But at the same time, the Russian business understands that the booty property of Ukraine and its residents in Crimea is a toxic asset. Therefore, the forecast suggesting that the Ukrainian property in Crimea will be purchased by those Russian individuals and entities that are already on the "Crimean" and other U.S. sanctions lists still holds true.

The Sale of the Crimean Winemaking Industry

The famous Novyi Svit Champagne Winery sold in December 2017 became the first major deal in the "privatization" of Ukraine's state property in Crimea.

The actual buyer of the plant was Yury Kovalchuk, a businessman under sanctions, who is very close to Putin, and the main owner of the Rossiya Bank (АО Акционерный банк "Россия"). It was the Rossiya Bank’s subsidiary that bought the stolen winery for 1.5 billion roubles. Note that it was not an isolated instance but rather a marker for a future trend.

In October 2020, the occupation government of Crimea decided to auction off the seized National Production and Agrarian Association Masandra (the Masandra Winery) owned by the state of Ukraine, which includes 8 large producers of grapes and wine on the Crimean coast from Yalta to Sudak and 12 wineries.

Masandra's wine collection (about 1 million bottles) is one of the largest in the world and was listed in The Guinness Book of Records in 1998. Masandra is one of the largest enterprises in Europe, specializing in growing grapes and producing high-quality vintage wines.

On 14 December 2020, it was purchased for 5.327 billion roubles by OOO Yuzhnyy Proyekt (OOO "Южный проект"), a subsidiary of the Rossiya Bank, which in December 2017 bought the Novyi Svit Champagne Winery in Sudak for 1.5 billion roubles. Also, the Crimean "government" reimburses the new owner of the enterprise for half of the vineyards costs.

OOO Yuzhnyy Proyekt is registered in St. Petersburg, Russia, and is 99.9% owned by the Rossiya Bank. The main shareholder and former chairman of the board of directors of the Rossiya Bank is Yuri Kovalchuk, who was dubbed "Putin's cashier" by the media.

After the occupation of Crimea, the United States and Ukraine imposed personal sanctions on Kovalchuk.

The Rossiya Bank is also under Ukrainian and U.S. sanctions. Ukraine and the U.S.A. have also imposed sanctions on OOO Yuzhnyy Proyekt.

In January 2021, the Crimean occupation authorities sold the property of the famous Koktebel vintage wine and cognac factory located in the eponymous resort village near Feodosiia.

The price of the illegal deal is 110 million roubles; the end buyer is OOO Gatchinskiy Spirtovoy Zavod (ООО "Гатчинский спиртовой завод") belonging to Mikhail Yakubchik, a relative of Sergei Naryshkin. The latter is the Director of the Foreign Intelligence Service of the RF; in 2011-2016, Naryshkin was the Chairman of the State Duma of the RF.

We can predict that in the near future, after the sale of the key enterprises, the entire huge winemaking industry of the Crimean economy will be sold to Russian owners. There are more than a dozen winemaking plants in different regions of Crimea.
